Porn sites to be BLOCKED in France unless they can verify users’ age

The French government has announced it will move to block five of the world’s major porn sites from tomorrow unless they introduce protective measures to ensure all users are aged 18 or over.

Adult websites Pornhub, xHamster, XVideos, XNXX and Tukif were given until today to implement stricter age controls on users looking to access their content.

The move by France’s Higher Audiovisual Council looks to force the websites to comply with a law introduced last year which made it compulsory to carry out proper age verification checks for adult content.

The council said the sites’ current tactic of simply asking users to fill out a check-box stating they are over 18 is not satisfactory and that they are breaking the law by failing to introduce better controls.  

If effective verification is not implemented, the council said it would ask a judge to block the sites. 

‘Children faced by such content can suffer lasting shock at the very least,’ the council said.

To successfully pass an acceptable age check, users would have to provide some form of verifiable identity document, or other personal information such as bank accounts, credit cards or mobile phone contracts.  

Justine Atlan, director of the child safety association e-Enfance, said: ‘It is important to put pornography sites under pressure so they cannot continue to flout the legal framework to which they have themselves agreed.’

‘The protection of children online is in no way contradictory to individual freedoms,’ he said.

The porn giant said it ‘has dedicated itself to developing industry-leading safeguards for the protection of its community.’

The move sees France align with European neighbours Germany in their efforts to bring about change in the adult industry by taking action against sites and organisations that do not prevent children from accessing adult content. 

The two EU-member states share some of the world’s strictest rules for the regulation of adult content. 

Britain meanwhile does not yet have such controls in place, but a cross-party parliamentary committee announced on December 14 that they would push for the upcoming Draft Online Safety Bill to include similar protections for children trying to access adult content.

The long-awaited legislation will impose a duty of care on tech giants to protect users from harmful content. It will install Ofcom as regulator with the power to fine them up to 10 per cent of their global turnover.

The Government has two months to respond to the committee’s recommendations and the bill is due to be put to Parliament next year.

PARIS, Sept 6 (Reuters) – A Paris court is set to rule next month on whether a French regulator has the right to block access to international porn sites in France unless those sites can guarantee they can prevent minors under 18 from accessing them.

Following a complaint by children’s rights associations, French audiovisual and digital regulator Arcom in December 2021 gave notice to five porn sites including Pornhub, requiring them to prove they were blocking access to minors in line with July 2020 French legislation.

An Arcom official said that since then the regulator had seen no indication the sites were putting in place systems that could really block access for minors, it decided to take legal action.

The four other sites being challenged by the regulator are Tukif, Xhamster, Xnxx and Xvideos.

The regulator said it wanted the court to order French internet service providers such as Orange, Free and SFR to block access to these porn sites on French territory until they have a solid system for blocking access to minors.

At a hearing on Tuesday, lawyers for the porn sites argued the court was not authorised to rule on the case as the law was not in line with the constitution. The court will now rule on Oct. 4 whether it can decide on the issue or whether the case needs to go to the appeals court, an Arcom official said.

Currently, porn sites in France only have to display a disclaimer button on which users can click to say that they are over 18, but there is no verification of their actual age.

An Arcom official said the sites – which are all free – would have to propose a free and reliable blocking system.

A lawyer for PornHub publisher MG Freesites did not immediately return calls for comment. She was quoted on French radio franceinfo as saying that verifying an internet user’s age is technically and legally impossible.

In recent months, Arcom has also served notice to several other porn sites, including YouPorn, one of the world’s top porn sites, the Arcom official said.

French children’s rights associations have started several legal cases to block access to online pornography for minors, arguing that current age verification standards make it too easy for children to access the websites. (Reporting by Geert De Clercq Editing by Tomasz JanowskiAr)

BRUSSELS, July 10 (Reuters) – The European Union has designated adult content platform XNXX as a very large online platform under its Digital Services Act (DSA), it said on Wednesday.

The rules under the DSA require companies to share data with authorities and researchers, conduct risk management, and undergo external and independent auditing.

They also allow the Commission to impose fines for incorrect, incomplete or misleading information in response to a request for information.
